HCSP is negotiated and agreed upon by a bargaining unit and/or employer.
If you are covered by a bargaining unit, contributions to the Plan must be agreed upon by both the bargaining unit and employer and written into a collective bargaining agreement or Memorandum of Understanding (MOU).
If you are not covered by a bargaining unit, contributions to the Plan must be agreed upon by the employer and included in a written personnel policy.
Once the employer/bargaining unit has included HCSP in the contract language or personnel policy, employee participation is mandatory. Only negotiated and agreed-upon contributions are allowed. Employees cannot choose to contribute more or less than what was negotiated.
Eligibility to participate
The employer/bargaining unit must indicate in the bargaining agreement or personnel policy the criteria for employee participation in the HCSP. For example, the agreement could specify that all full-time employees who have 10 years of service will contribute a percentage of their payroll to the HCSP. Employees who meet the criteria must participate in the manner indicated in the contract.
