If you die while serving as a legislator, your surviving spouse and
dependent children are eligible for monthly survivor benefits. If you
have no surviving spouse or dependent children, your beneficiary
would be eligible for a refund of your contributions, plus 6
percent interest.
Your surviving spouse and dependent children are also eligible for
monthly survivor benefits if you are a former legislator with six or
more years of service.
Surviving Spouse Coverage
Your surviving spouse is eligible for lifetime, monthly benefits.
If you die under age 60, your spouse will receive one-half the amount
of the retirement benefit you earned at the date of death. This
survivor benefit is payable regardless of your survivor's age. The minimum survivor
benefit assumes you had eight years of legislative service. The
surviving spouse of a legislator over age 60 is entitled to receive
the 100 percent optional joint and survivor benefit if it is higher than
the minimum survivor benefit.
Dependent Children Survivor Coverage
A dependent child under age 18, or a dependent child to age 22 if attending an accredited school full
time is entitled to
monthly survivor benefits. The
oldest dependent child is entitled to 25 percent of your monthly
benefit
earned at the date of death, and each additional child receives 12.5
percent
of your monthly benefits.
The maximum family benefit is 100 percent of the monthly benefit you
would have been eligible for full retirement at the date of your
death. |
